Terms of Service.

Community Sign-Up

Joining the community does not guarantee access to the Spotti app, reservation of any parking space, priority service, or rewards eligibility. Features, pricing, fees, geographic availability, and product offerings described on this site reflect current plans and are subject to change at any time without notice.

Private Parking Rentals

Spotti operates a technology platform that enables property owners to list parking spaces and renters to book them. Spotti is not a parking facility operator, parking garage, parking lot, or commercial parking facility. Spotti does not own, lease, manage, control, or operate any parking space listed on the platform. By submitting your information, you are joining an interest list only and are not entering into any rental, license, or service agreement. Property owners (“Hosts”) are solely responsible for verifying and maintaining compliance with all applicable laws and restrictions, including but not limited to zoning ordinances, building codes, curb cut permits, parking operator registrations, business licenses, HOA covenants, condo bylaws, cooperative rules, deed restrictions, and residential lease terms. Hosts are solely responsible for collecting and remitting any applicable taxes, including parking occupancy taxes, sales taxes, and income taxes. Spotti does not collect or remit taxes on behalf of Hosts except where required by applicable law or where Spotti elects to do so in its sole discretion. Spotti makes no representations regarding the legal permissibility of any listing. Spotti does not guarantee rental income, booking volume, occupancy rates, pricing outcomes, or any specific financial result. Standard homeowner's or renter's insurance policies may exclude coverage for renting parking to non-residents. Hosts are responsible for obtaining appropriate insurance coverage.

Peer-to-Peer Spot Sharing

Spotti's peer-to-peer module facilitates communication between users about publicly available street parking. Spotti is not a parking operator and does not own, control, monitor, or guarantee any street parking spot. Information shared by users is user-generated and unverified. Spotti makes no representations regarding the accuracy, availability, legality, or safety of any parking spot. Users are solely responsible for complying with all posted parking signage, alternate side parking rules, street cleaning schedules, fire hydrant clearances, no-parking zones, time limits, and other applicable traffic and parking regulations. Use of the service is at the user's own risk.

Rewards

Gift cards, app credits, and early adopter rewards may be distributed after Spotti launches in your area. Reward type (app credits, gift cards, or other) will be determined by Spotti at the time of distribution. Eligibility is limited to verified accounts in eligible neighborhoods at Spotti's sole discretion. Spotti reserves the right to modify, suspend, or cancel the rewards program at any time, for any reason, without prior notice. Rewards are not earned, vested, or guaranteed upon joining the community. Distribution timing is at Spotti's sole discretion and may occur weeks or months after launch. Limit one reward per verified user. Reward values, types, quantities, and availability are subject to change. Rewards are non-transferable, have no cash value, cannot be combined with other offers, and may be void where prohibited by law.

No Warranties

All information on this site is provided “as is” without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. Spotti is not a licensed attorney, financial advisor, tax professional, or insurance broker. Nothing on this site constitutes legal, financial, tax, or professional advice.

Limitation of Liability

To the maximum extent permitted by law, Spotti, Inc., its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to property damage, loss, theft, vehicle damage, personal injury, traffic violations, parking tickets, towing, or any other losses arising from use of the Spotti site, app, or services. In no event shall Spotti's total aggregate liability to you for all claims arising out of or related to your use of the site or services exceed the greater of (a) the amounts you have paid to Spotti in the twelve (12) months preceding the claim, or (b) fifty dollars ($50.00).

Governing Law

These terms and your use of the Spotti site and services are governed by the laws of the State of Delaware, without regard to its conflict of laws principles.

Dispute Resolution

Before initiating any formal proceeding, both parties agree to attempt in good faith to resolve any dispute through confidential mediation administered by JAMS or the American Arbitration Association under their respective mediation rules, with mediation to take place virtually or in New York, New York. If the dispute is not resolved within sixty (60) days of the written demand for mediation, the dispute shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration shall take place virtually or in New York, New York. The arbitrator's decision shall be final and binding. You and Spotti agree that any dispute will be brought solely in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The right to a jury trial is waived.

Severability

If any provision of these Terms of Service is found to be unenforceable, the remaining provisions will remain in full force and effect.

Force Majeure

Spotti shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including acts of God, natural disasters, pandemics, war, terrorism, government action, labor disputes, or internet service interruptions.

Entire Agreement

These Terms of Service, together with the Spotti Privacy Policy, constitute the entire agreement between you and Spotti regarding use of this site.

Changes

Spotti reserves the right to modify these Terms of Service at any time. Continued use of the site after changes are posted constitutes acceptance of the modified terms.
